A man originally facing seven charges involving alleged incidents involving two teens was given a year in jail April 12 after striking a plea agreement in January that reduced the charges to two counts of sexual battery.
Court documents show that on Jan. 26, Jeffrey Allen Miller, 41, Marion, entered an Alford plea on sexual battery charges. An Alford plea is a guilty plea in court but the defendant does not admit the crime and asserts innocence despite the guilty plea.
Miller was charged two years ago with two counts of aggravated indecent liberties with a child, two counts of indecent solicitation of a child, furnishing alcohol to minor for illicit purposes, furnishing alcohol to a minor, and eavesdropping was given a year in jail April 12 after striking a plea agreement in January that reduced his charges to two counts of sexual battery.
Miller’s sentence could be converted to house arrest after he spends six months in jail. He will be on supervised probation with special conditions after serving his sentence.
As part of his probation, he will be required to submit to random drug and alcohol tests. Positive tests, refusing testing, or admitting substance abuse could result in extra jail time.
Miller was also ordered to undergo mental health assessment to determine if he needs sex offender treatment at his own cost. He must also register as a sex offender and submit a DNA specimen for registration, also at his own cost.
He was ordered to pay $158 court costs, $60 probation fee, $100 for his appointed attorney, and a $45 booking fee.
