The following information has been filed in the criminal division of Marion County District Court:
Michael S. Nelson, three counts of violation of a protective order; bond appearance at 10:30 a.m. Sept. 11.
Roscoe J. Czarnowsky, five counts of non-support of a child (violation date of Jan. 1); arraignment at 9:45 a.m. Sept. 24.
Theodore James Ellis, domestic battery; defendant appeared from probable cause arrest and is indigent, court appointed attorney David Harger, bond is set at $500 cash or cash surety, no contact with victim unless she requests; arraignment at 9:45 a.m. Aug. 27.
Andrew M. White, sale or possession with intent to sell hallucinogens, no drug tax stamp, possession of depressants, stimulants, hallucinogenics, steroids, possession of simulated controlled substances or drug paraphernalia, criminal possession of firearm, failure to drive on right side of roadway as required; defendant appeared on bond and intends to retain private counsel, bond to continue; preliminary hearing at 9:30 a.m. Sept. 5.
Cory Helmstead, burglary of a building used as a dwelling, theft of less than $1,000, criminal damage to property less than $500; first appearance at 10:30 a.m. Sept. 11.
Roscoe J. Czarnowsky, theft of less than $1,000, criminal trespass (violation date of Aug. 15); arraignment held, defendant pleaded not guilty; jury trial at 8:30 a.m. Oct. 26, instructions due by Oct. 16.
Paul E. Rasberry, attempted indecent solicitation of child 14 to 16 years of age, possession of depressants, stimulants, hallucinogenics, steroids, possession of simulated controlled substances or drug paraphernalia; defendant waived formal arraignment, court accepted waiver and pleaded not guilty to count one, court noted plea, bond continues as previously set; plea hearing held Aug. 27; sentencing at 11 a.m. Oct. 9.
James D. Parmley, deferred adjudication of unlawful discharge of firearms diversion agreement with order of continuance and dismissal (60 days to pay, six months).

William M. Hess, arraignment held, defendant pleaded not guilty; motion hearing to suppress/status of trial setting at 9 a.m. Sept. 27.

Shelia Deines, battery (violation date of Feb. 24, 2006); defendant appeared on bond and waived counsel, bond to continue; sentencing at 11 a.m. Oct. 10.
Randy Herbel, rape, sexual intercourse with a child less than 14 years of age (violation date of Aug. 1, 2006); hearing held for state's motion for Jackson vs. Denno and the defense's motion to suppress, court found it was a non-custodial interrogation by Rick Atteberry, court found no indication of threats, coercion or promises being made, court found the defendant was not so emotional that he didn't know what he was doing, court found the defendant's confession was voluntary and will allow the state to use, court denied defendant's motion to suppress; matter set for status hearing Aug. 27; motion hearing at 9:45 a.m. Oct. 1; jury trial set for 8:30 a.m. Dec. 12.

Randy Herbel, rape, sexual intercourse with a child less than 14 years of age, aggravated indecent liberties with a child less than 14 years of age (violation date of Aug. 2, 2006); pre-trial motions at 9:45 a.m. Oct. 1, jury trial begins at 8:30 am. Dec. 12.
Joe William Garcia, giving a worthless check of less than $500; order of dismissal, defendant paid court costs and restitution, upon motion of county attorney matter dismissed without prejudice.
Justin Harmon, theft of more than $500 and less than $25,000 (violation date of Nov. 23, 2004); defendant appeared on bond and intends to retain private counsel, bond to continue, preliminary hearing at 9:30 am. Oct. 3, hearing set outside 10-day limit due to defendant's request to retain private counsel.
