Student sues school district

A lawsuit against USD 408 is pending in Marion County District Court.

The suit was filed by Cody Cook and his parents, Frank and Brenda Cook.

The petition seeks compensation for injuries and damages suffered by Cody Cook on Feb. 14, 2006, when he was a student in a shop class and his left hand was caught in a table saw dado blade, causing a severe laceration.

The petition claims the injuries and damages suffered by the student were caused by negligence.

David Harger of Bremyer & Wise, LLC of McPherson, is the attorney for the Cooks. In a response to the school district’s request for a statement of monetary damages, the attorney stated that medical expenses to date are $18,833. Other damages including anticipated future medical expenses, future income impairment, and past and future pain, suffering, and disfigurements, totaled $500,000, for a grand total of $518,833 in damages.

No court dates have been set for hearings at this time.
