Katheryn Nycole Dale’s preliminary hearing in the death of her son, Vincent Hill, was continued again Monday in Harvey County District Court. The 19-month-old died March 27 of blunt force trauma and asphyxiation. Dale, 21, and her boyfriend, Chad Carr, are charged in the death.
The boy was a son of Richard Hill and grandson of Jim and Gail Myers, all of Peabody.
Dale is next scheduled to appear before District Judge Joe Dickinson at 9 a.m. July 29.
Dale’s attorney, Gregory Barker, entered a motion to have Dale released from jail on her own recognizance.
“She has already been in jail a lengthy time,” he said.
Harvey County Attorney David Yoder said he did not oppose Barker’s request for a continuance but argued a bond reduction would be inappropriate because of the felony charges against Dale.
She has been charged with two counts of felony endangerment of a child, one count of felony abuse of a child, and one count of aggravated battery.
“The state would be opposed to having her released on her own recognizance,” he said. “The Level 4 felony charge presumes some prison time if she is found guilty. The other charges are serious abuse and neglect. In the state’s view a reduced bond at this time is not justified.”
Dickinson ruled Dale’s bond would remain at $50,000.
At a preliminary hearing July 9, Carr was bound over for trial on first-degree murder charges in Vincent Hill’s death. Both he and Dale remain in the Harvey County Detention Center.
