Jenny Marie Herzet, felony theft amended to theft value $1,000 to less than $25,000 (violation date of Sept. 9); bond appearance hearing at 10:30 a.m. Oct. 27.

Landon H. Coen, possession of hallucinogenics, possession of simulated controlled substances or drug paraphernalia; bond appearance hearing at 10:30 a.m. Oct. 27.

Donald D. Feckner Jr. possession of opiates, opium, or narcotic drugs; first appearance hearing held, defendant informed court he intended to retain private counsel, bond was set at $5,000; preliminary hearing held Oct. 1.

Wesley Robert Loud, possession of simulated controlled substances or drug paraphernalia; first appearance hearing at 10:30 a.m. Nov. 24.

David J. Cloud, possession of simulated controlled substances or drug paraphernalia, DUI, driving while license suspended, no vehicle liability insurance, transporting an open container, improper driving on laned roadway, unlawful acts with a vehicle; first appearance hearing held, defendant was found indigent or partially indigent and the court appointed attorney Dan Baldwin, bond was set at $5,000; arraignment hearing at 9:45 a.m. Nov. 3.

Jon C. Gibbons, possession of hallucinogenics, possession of simulated controlled substances or drug paraphernalia, criminal use of weapons, driving while license suspended, transporting an open container; first appearance hearing at 10:30 a.m. Oct. 14.

Rachael Guzman, defendant was indigent or partially indigent and court appointed attorney Brent Boyer, bond was continued; preliminary hearing at 9:30 a.m. Oct. 22.

Lindsey Nicole Buckbee, worthless check less than $1,000; upon motion of the county attorney the case was dismissed without prejudice and costs assessed to the state, defendant had paid court costs and restitution in full.

Kyle Lee Brooks, defendant waived counsel at this time, summons was continued; arraignment hearing at 10:15 a.m. Dec. 10.

Marion A. Bina, criminal threat, disorderly conduct; defendant pleaded no contest to count two, upon motion of the county attorney count one was dismissed with prejudice; defendant was sentenced to a controlling sentence of 30 days in the custody of Marion County Sheriff which was suspended, defendant was placed on immediate supervised probation with court services officer for 12 months; defendant was ordered to attend counseling, take all prescribed medications and sign a release form, shall not be allowed to enter the Marion County Treasurer’s office, and pay court costs of $137, probation fee of $25, fee of $1000, and court-appointed attorney fees of $600.

Patricia Woolridge, criminal use of a financial card, theft value less than $1,000; upon motion of the county attorney the case was dismissed without prejudice and costs assessed to the state.

Byam A. Lacy, arraignment rescheduled to 9:45 a.m.. Nov. 3.

Jennifer Rene Hubbard, criminal damage to property more than $500 and less than $25,000; defendant pleaded not guilty; jury trial to begin at 8:30 a.m. Jan. 9, 2009.

Machelle A. Ratzloff, sentencing at 11 a.m. Jan. 5, 2009.

Matthew A. Hosey, motion hearing rescheduled to 10 a.m. Nov. 24.

Michael S. Fuhr, endangering a child under the age of 18, furnishing alcohol to a minor, purchase/consumption of alcoholic liquor/CMB by a minor; defendant pleaded no contest to count three and upon motion of the county attorney charges one and two were dismissed with prejudice; defendant was sentenced to a controlling sentence of 30 days in the custody of Marion County Sheriff, court ordered the defendant to serve said time and said time shall run concurrent to McPherson County sentence, the court suspended imposition of sentence for service until such time as McPherson County sentence begins, defendant ordered to pay court costs of $137, court-appointed attorney fees as determined by the court, a fine of $200, set up a payment plan as part of his parole plan, and driving privileges shall be suspended for 30 days.

Richard Todd Litton, original charges of aggravated robbery was amended to assault, battery amended to possession of depressants, stimulants, hallucinogenics, steroids, theft by deception less than $500 (violation date of Nov. 21, 2006); motion to revoke probation, sentencing at 11 a.m. Nov. 3.

Walter H. Patterson, arraignment hearing rescheduled to 9:45 a.m. Nov. 3.

Dominic Louie Voelker, theft value at least $25,000 but less than $100,000 amended to theft value of at least $1,000 but less than $25,000; upon motion of the county attorney the case was dismissed without prejudice and costs assessed to the state.
