Clinic again ordered sold

A former Herington Hospital clinic in Hillsboro is back on the auction block, with a sheriff’s sale set for two weeks from now.
The building, at 108, 112, and 114 S. Main St. in Hillsboro, was awarded Dec. 4 to Emprise Bank as part of a mortgage foreclosure. It was scheduled for a sheriff’s sale Jan. 25, but the day it was to be sold, lawyers for the bank called off the sale.
Herington resident Robert Danzman, a longtime opponent of the way the hospital was operated but now president of its board of directors, filed a petition Dec. 28 seeking emergency relief from all court orders that granted hospital money or property to the bank.
Danzman amended the motion Feb. 8, asking for a hearing. A hearing was set for Feb. 27, but Danzman was in a hospital and could not attend.
Although he sent the court a proposed order for a continuance and medical documents, lawyers for the hospital filed a proposed order seeking that Danzman’s request for relief be denied because he had not shown up.
Judge Keith Collett mailed Danzman’s unopened request for a continuance back to him that same day.
Even before the hearing, the bank’s lawyers submitted a new order for a sheriff’s sale.
The bank also filed a second lawsuit against 10 other companies that might have financial interests in hospital property it was awarded in the first suit.
